π Description of Coaching
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the Client to maximize personal and professional potential. It is designed to facilitate the creation and development of personal, professional, or business goals, and to develop and carry out a strategy and plan for achieving those goals.
By using this website or engaging in coaching services with Infinite Mind Coach, you agree to be bound by the following Terms and Conditions.
About Infinite Mind Coach
Infinite Mind Coach is a professional mindset coaching practice owned and operated by Susmita Ghosh, accessible at infinitemindcoach.com. We provide one-on-one mindset coaching services to:
- Individual Professionals β Personal and professional growth coaching
- Parents β Coaching for mindset transformation
- Minors β Children (10-12 yrs) focused coaching in presence of parents
All services are delivered in accordance with the International Coaching Federation's (ICF) guidelines and methodology.
Minor Coaching Policy
Infinite Mind Coach provides specialized coaching for children and preteens aged 10β12 years, conducted exclusively in the presence of at least one parent or legal guardian. The following guidelines apply to all child and preteen coaching engagements:
- Parental Presence β A parent or legal guardian is required to attend every coaching session without exception.
- Consent & Agreements β All consent forms and coaching agreements must be reviewed and signed by a parent or legal guardian prior to the commencement of any coaching engagement.
- Coaching Commencement β Coaching sessions will only begin once full parental consent has been formally obtained and all required documentation has been completed.
These guidelines are in place to ensure the safety, wellbeing, and best interests of every child we have the privilege of working with, in full alignment with the International Coaching Federation's (ICF) ethical standards.
The parent or legal guardian (βParentβ) expressly acknowledges and agrees that they are solely and fully responsible for the minorβs participation in all coaching sessions provided by Infinite Mind Coach. The Parent understands and agrees that participation in coaching is voluntary and that the Parent assumes all risks, known and unknown, associated with the minorβs participation, including but not limited to emotional responses, behavioral reactions, or changes in mindset, communication, or decision-making that may arise during or after coaching sessions.
The Parent further confirms that they have the legal authority to provide consent for the minorβs participation and agrees to supervise or be present during sessions as required. The Coach shall bear no responsibility or liability for any decisions made by the Parent or minor, or for any outcomes, interpretations, or actions taken by the minor or Parent arising from or related to the coaching services.

The Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation (ICF) (coachfederation.org/ethics). It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behavior.
B Client Responsibility
The Client is solely responsible for creating and implementing their own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and coaching interactions. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.
The Client understands that coaching services are non-clinical and educational in nature and do not constitute therapy, counseling, psychological treatment, or medical services.
C Right to Terminate
The Client acknowledges that they may terminate or discontinue the coaching relationship at any time, subject to the Cancellation and Termination policies outlined in these Terms.
D Scope of Coaching
The Client acknowledges that coaching is a comprehensive process that may involve different areas of life, including work, finances, health, relationships, education, and recreation. The Client agrees that deciding how to handle these issues and implementing choices is exclusively the Client's responsibility.
E No guarantee of Resullts
The Client expressly acknowledges and agrees that coaching services provided by Infinite Mind Coach are subjective, personalized, and dependent on the Clientβs own efforts, decisions, circumstances, and level of participation. The Client understands that results from coaching vary widely between individuals and are influenced by numerous factors beyond the Coachβs control. Accordingly, the Coach makes no representations, warranties, or guarantees, express or implied, regarding any specific outcomes, improvements, achievements, or results that may be obtained through the coaching services. Any examples of past client experiences, testimonials, or illustrative results are provided solely for informational purposes and do not constitute a promise, assurance, or guarantee that the Client will achieve similar outcomes. The Client further acknowledges that they remain solely responsible for their own actions, decisions, and implementation of any strategies, insights, or suggestions discussed during coaching sessions.
F Not a Substitute for Professional Care
The Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association. Coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals. It is the Client's exclusive responsibility to seek such independent professional guidance as needed.
If the Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform their mental health care provider of the nature and extent of the coaching relationship.
G Client Commitment
The Client agrees to communicate honestly, be open to feedback and assistance, and to create the time and energy to participate fully in the coaching program.
Coaching Services
The parties agree to engage in a coaching program delivered through agreed-upon methods (online only, through video conferencing tools such as Zoom, Google Meet or Microsoft Teams). The Coach will be available to the Client by email between scheduled sessions as defined by the Coach.
The Client acknowledges and agrees that coaching services are dependent on third-party platforms and service providers that are outside the control of the Coach, including but not limited to video conferencing platforms such as Zoom, Google Meet, Microsoft Teams, internet service providers, hosting services, and related digital communication tools. The Coach shall not be responsible or liable for any delay, disruption, failure, interruption, or degradation of coaching services caused by technical issues, platform outages, connectivity problems, software malfunctions, cyber incidents, or any other circumstances beyond the Coachβs reasonable control.
Schedule & Fees
- Coaching sessions will last for 45 minutes.
- To ensure the best fit for both of us, payment details and the payment page are only shared after a discovery call and a mutual agreement to proceed with coaching. - The scheduling of coaching sessions is the Client's responsibility, managed through Calendly.
- Should the Coach be unavailable for a scheduled session, the Client will be notified in advance. Equally, it is the Client's responsibility to inform the Coach in advance if they are unable to attend a scheduled session.

π Rescheduling, Cancellation & No-Show Policy
- π Rescheduling Policy β To reschedule a coaching session, the Client must contact the Coach by email only at least 48 hours prior to the scheduled session. Requests received after this deadline will not be accommodated, and the session fee will be forfeited. Prepaid fees for the missed session will not be refunded or credited.
- β Cancellation Policy β To cancel a coaching session, the Client must contact the Coach by email only at least 48 hours prior to the scheduled session. Cancellations received after this deadline will be treated as a late cancellation, and the session fee will be forfeited. Prepaid fees for the cancelled session will not be refunded.
- π« No-Show Policy β A no-show occurs when the Client fails to attend a scheduled session without providing at least 48 hours' prior written notice by email. No-show sessions are considered forfeited, and all prepaid fees for that session will be non-refundable. No exceptions will be made.

Confidentiality
This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics.
Please be aware that the CoachβClient relationship is not considered a legally confidential relationship (unlike the medical and legal professions), and communications are not subject to the protection of any legally recognized privilege.
The Coach agrees not to disclose any information pertaining to the Client without the Client's written consent. The Coach will not disclose the Client's name as a reference without the Client's consent.
Confidential Information does not include information that:
- Was in the Coach's possession prior to its being furnished by the Client
- Is generally known to the public or in the Client's industry
- Is obtained by the Coach from a third party, without breach of any obligation to the Client
- Is independently developed by the Coach without use of or reference to the Client's confidential information
- The Coach is required by statute, lawfully issued subpoena, or by court order to disclose
- Is disclosed to the Coach and as a result the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others
- Involves illegal activity
The Client acknowledges their continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
π Data Use Limitation: The Client acknowledges and agrees that any personal information collected, received, or stored by Infinite Mind Coach is used solely for the purpose of delivering coaching services, including but not limited to client onboarding, scheduling sessions, communication related to services, payment processing coordination, record-keeping, and compliance with applicable legal or regulatory obligations. The Coach shall not sell, rent, or trade Client personal data to third parties. Personal information may only be shared with trusted third-party service providers (such as scheduling platforms, payment processors, or email systems) strictly for the purpose of facilitating service delivery. These third parties are required to maintain appropriate confidentiality and data protection standards. The Client understands that data may be retained for a reasonable period of time as required for business, legal, tax, or dispute resolution purposes, even after the coaching relationship has ended.
π Data Access, Correction, and Deletion Requests: The Client has the right to request access to, correction of, or deletion of their personal data held by Infinite Mind Coach, subject to applicable legal, regulatory, and record retention requirements. Upon receipt of a written request, the Coach will make reasonable efforts to respond within a commercially reasonable timeframe. However, the Coach may retain certain information where deletion is not permitted or is required for legitimate business purposes, including but not limited to compliance with legal obligations, financial record-keeping, fraud prevention, dispute resolution, or enforcement of these Terms and Conditions. The Client acknowledges that deletion of certain data may limit or prevent the Coach from continuing or resuming coaching services.
Release of Information
The Coach engages in training and continuing education pursuing and/or maintaining ICF Credentials. That process requires the names and contact information of all Clients for possible verification by ICF. By agreeing to these Terms, you agree to have only your name, contact information, and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship. No personal notes will be shared.
Scope of Coaching Services
My coaching services are designed to support personal growth, mindset development, and transformational change for professionals, parents, and children. While I am deeply committed to guiding you on your growth journey, it is important to acknowledge that certain areas fall outside the scope of my coaching expertise.
- Marriage counseling or conflict resolution
- Divorce guidance or legal advice
- Relationship repair or couples therapy
- Addiction recovery or substance abuse support
Record Retention Policy
The Client acknowledges that the Coach maintains a record retention policy with respect to documents, information, and data acquired or shared during the term of the CoachβClient relationship.
Such records will be maintained by the Coach in a format of the Coach's choice (print or digital/electronic) for a period of not less than 2 years.
Termination
Either the Client or the Coach may terminate this Agreement at any time with written notice.
The Client agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.
Limited Liability
Except as expressly provided in this Agreement, the Coach makes no guarantees, representations, or warranties of any kind or nature, express or implied, with respect to the coaching services rendered.
Notwithstanding any damages that the Client may incur, the Coach's entire liability under this Agreement, and the Client's exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date.
To the fullest extent permitted by applicable law, the Coach shall not be liable to the Client or any third party for any indirect, incidental, consequential, special, exemplary, punitive, or reliance damages arising out of or relating to the coaching services or these Terms and Conditions, whether such damages are based in contract, tort, negligence, strict liability, or otherwise, even if the Coach has been advised of the possibility of such damages. Such excluded damages include, without limitation, claims for emotional distress, mental anguish, loss of income, loss of profits, loss of business opportunities, business interruption, reputational harm, or any alleged failure to achieve desired results or outcomes from the coaching services. The Client acknowledges that coaching outcomes are not guaranteed and agrees that their sole and exclusive remedy for any claim arising out of the coaching services shall be limited to the amount actually paid by the Client for the specific coaching services giving rise to the claim, as set forth in these Terms.
Intellectual Property & Copyright
You are not permitted to copy, reproduce, distribute, or use any content, text, images, graphics, or other materials from the infinitemindcoach.com website without prior written permission from Susmita Ghosh.
All website content and images are protected by copyright law. Unauthorized use of any copyrighted materials is strictly prohibited.
Limited License to Coaching Materials: The Coach grants the Client a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use any coaching materials, worksheets, frameworks, resources, or content provided during the course of the coaching engagement solely for the Clientβs personal, non-commercial use in connection with their individual coaching experience. The Client expressly agrees that such materials remain the sole intellectual property of Infinite Mind Coach and/or Susmita Ghosh and are protected under applicable copyright and intellectual property laws. The Client shall not, under any circumstances, copy, reproduce, modify, distribute, share, publish, transmit, sell, sublicense, or otherwise commercially exploit any coaching materials, in whole or in part, without the prior express written consent of the Coach. Any unauthorized use of coaching materials shall constitute a material breach of these Terms and may result in immediate termination of services without refund, as well as pursuit of any available legal remedies.
Entire Agreement
Coaching services shall not commence until all required agreements and consent forms have been reviewed and signed by all required parties. This document reflects the entire agreement between the Coach and the Client, and reflects a complete understanding of the parties with respect to the subject matter.
This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered, or supplemented except in writing signed by both the Coach and the Client.
Dispute Resolution
If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice is given.
If the dispute is not resolved through mediation, and in the event of legal action, the prevailing party shall be entitled to recover attorney's fees and court costs from the other party.
1. Good Faith Negotiation. In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Coaching Services, you and [Infinite Mind Coach] (the "Parties") agree to first attempt to resolve the matter informally. The complaining party must send a written "Notice of Dispute" to the other party. The Parties agree to use their best efforts to settle the dispute through direct consultation and good faith negotiations for a period of at least thirty (30) days following the receipt of the Notice.
2. Mandatory Mediation. If the dispute cannot be resolved through negotiation within thirty (30) days, the Parties agree to submit the dispute to non-binding mediation before a mutually agreed-upon mediator in [Howard], Maryland. The Parties will share the cost of the mediator and any filing fees equally. In any dispute arising under this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs. Participation in mediation is a condition precedent to either party initiating a lawsuit, except as provided in the "Small Claims" section below.
3. Small Claims Court Exception. Notwithstanding the mediation requirement above, either party may bring an individual action in the District Court of Maryland (Small Claims Court) if the claim is within the court's jurisdictional limit (currently $5,000 or less) and does not seek equitable relief (like an injunction).
4. Choice of Law and Venue. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. For any litigation not handled in Small Claims Court, the Parties agree to the exclusive jurisdiction and venue of the state or federal courts located in Howard County, Maryland. Clients accessing services from outside the United States acknowledge that they do so voluntarily and are responsible for compliance with their local laws. Coaching services are deemed provided in Maryland, USA.
Severability
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
If a court finds that any provision is invalid or unenforceable but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Waiver
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time to reflect changes in our practices, legal requirements, or service offerings. When changes are made, we will:
- Update the Effective Date at the top of this page
- Notify active coaching clients via email of any material changes
- Post the updated Terms prominently on infinitemindcoach.com
Any updates to these Terms shall not apply retroactively to services or packages already purchased and paid for prior to the Effective Date of such changes.
Your continued use of our website or coaching services after any changes constitutes your acceptance of the updated Terms and Conditions. We encourage you to review this page periodically.
